This End User License Agreement ("EULA") is a legal agreement between you ("you" or "User") and Victura ("Licensor") for the Victura mobile application software and related documentation (the "App").

By downloading, installing, or using the App, you agree to this EULA. If you do not agree, do not install or use the App.

This EULA supplements our Terms of Service and Privacy Policy. If there is a conflict, the Terms of Service govern your use of the Service generally; this EULA governs the software license.

1. License grant

Subject to your compliance with this EULA and the Terms of Service, Victura grants you a limited, non-exclusive, non-transferable, revocable license to install and use one copy of the App on a device you own or control, solely for personal, non-commercial use.

2. License restrictions

You may not:

  • Copy, modify, or create derivative works of the App except as permitted by law.
  • Reverse engineer, decompile, or disassemble the App except where prohibited restrictions are not enforceable under applicable law.
  • Rent, lease, sell, sublicense, or distribute the App.
  • Remove proprietary notices or labels.
  • Use the App to build a competing product or to scrape or abuse backend APIs.

3. Ownership

The App is licensed, not sold. Victura and its licensors retain all rights, title, and interest in the App, including all intellectual property rights.

4. App Store terms

If you obtained the App through the Apple App Store or Google Play:

  • This EULA is between you and Victura, not the store operator.
  • The store operator has no obligation to provide maintenance or support for the App.
  • In the event of failure to conform to any applicable warranty, you may notify the store operator for a refund of the purchase price (if any) in accordance with store policies. To the maximum extent permitted by law, the store operator has no other warranty obligation.
  • The store operator is a third-party beneficiary of this EULA and may enforce it against you.

5. Updates

Victura may provide updates, patches, or replacements. Updates may be required for continued use. This EULA applies to updates unless accompanied by separate terms.

6. Subscription features

Premium features may be offered in the future through in-app purchase. When available, billing and renewal are handled by the applicable app store. As of the Last Updated date, in-app purchase integration is not live in the production build; subscription UI may appear for future releases.

7. Data and privacy

Your use of the App involves collection and processing of personal data as described in our Privacy Policy.

8. Disclaimer of warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. VICTURA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Nutrition estimates and AI outputs may be inaccurate. The App does not provide medical advice.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VICTURA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF USE OF THE APP.

Where liability cannot be excluded, Victura's total liability shall not exceed the greater of USD $100 or amounts you paid for the App or in-app purchases in the twelve months preceding the claim.

10. Termination

This license is effective until terminated. It terminates automatically if you breach this EULA. Upon termination, you must cease use and delete the App. Sections intended to survive termination will survive.

11. Export compliance

You represent that you are not located in a country subject to export embargo and are not on any government restricted-party list.

12. Changes

We may update this EULA. Continued use after posting the revised EULA at victura.app/eula constitutes acceptance.
